1. Acceptance of Terms

Welcome to WixeChat ("Company," "we," "our," or "us"). These Terms and Conditions govern your access to and use of the WixeChat mobile applications, web platform (located at wixechat.com and associated domains), APIs, and communication services (collectively, the "Service").

By creating an account, browsing the feed, uploading content, or using our messaging and calling features, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately discontinue use of the Service.

2. Eligibility & Account Security

You must be at least 13 years of age (or the minimum legal age in your jurisdiction) to create an account on WixeChat. If you are between the ages of 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

You may not create accounts through automated methods, bots, or scrapers. You agree to provide accurate and complete registration information and keep your profile details current.

3. User-Generated Content

You retain all ownership rights in the photos, videos, stories, reels, audio clips, comments, and messages you submit or publish through WixeChat ("User Content").

By posting User Content, you grant WixeChat a non-exclusive, worldwide, royalty-free, transferable license to host, store, display, reproduce, modify (e.g., transcoding video formats or resizing avatars), and distribute your content solely for the purposes of operating, improving, and promoting the Service.

You represent and warrant that you own or have obtained all necessary licenses, copyrights, permissions, and rights to upload your User Content without infringing upon any third-party intellectual property or privacy rights.

4. Prohibited Conduct

To ensure a safe, engaging, and welcoming community, you agree not to engage in any of the following prohibited behaviors:

• Hate Speech & Harassment: Bullying, threatening, stalking, defaming, or inciting violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or nationality.
• Explicit / Illegal Content: Sharing non-consensual sexual media, child sexual abuse material (CSAM), violence, self-harm promotion, or content promoting illegal substances or activities.
• Spam & Manipulation: Artificial follower boosting, automated bot posting, sending unsolicited bulk direct messages, or operating deceptive engagement pods.
• Impersonation & Fraud: Impersonating another person, creator, brand, or WixeChat representative, or creating false accounts to deceive users.
• System Abuse: Reverse engineering, decompiling, hacking, introducing malware, scraping platform data without written permission, or attempting to bypass security filters.

5. Creator Fund & Monetization Terms

Eligible creators may apply for monetization through the WixeChat Creator Fund in their Profile Settings. Qualification is subject to continuous compliance with our Creator Guidelines and eligibility thresholds:

• Minimum follower and original post count as determined by system administrators.
• Active account standing with zero unresolved community guideline infractions or copyright strikes.
• Authentic engagement with real audiences (artificial view inflation will result in immediate disqualification and forfeiture of accrued balances).

Payouts are processed in USD via supported payment processors (e.g., Stripe Connect, PayPal, or direct bank transfer) on a monthly schedule, subject to a minimum payout threshold of $50.00 USD. Creators are responsible for all applicable taxes arising from their creator earnings.

6. Messaging & WebRTC Voice/Video Calling

WixeChat provides real-time text messaging, voice notes, and peer-to-peer WebRTC voice and video calling.

Signaling data (SDP offers, answers, and ICE candidates) is transmitted through encrypted Firebase Firestore channels and STUN/TURN relays. Audio and video streams are encrypted in transit using standard WebRTC protocols (DTLS-SRTP). We do not record or store your live audio or video calls on our servers.

7. Intellectual Property & DMCA Copyright Policy

The WixeChat brand name, logo, UI/UX designs, trademarks, and proprietary codebase are the exclusive property of WixeChat and its licensors.

We respect the intellectual property rights of others. If you believe your copyrighted work has been copied in a way that constitutes infringement, please submit a formal DMCA notice to our designated copyright agent at dmca@wixechat.com including:

• Identification of the copyrighted work claimed to have been infringed.
• URL or specific post identifier of the infringing material.
• Your contact details (name, address, telephone number, email).
• A statement of good faith belief that the disputed use is unauthorized.
• A statement under penalty of perjury that the notification is accurate and you are authorized to act on behalf of the owner.

8. Account Suspension & Termination

You may delete your WixeChat account at any time in your Settings. Upon deletion, your profile, posts, reels, and stories will be permanently removed from public view.

We reserve the right to suspend, restrict, or terminate your account immediately, without prior notice or liability, if you violate these Terms, our Community Guidelines, or applicable laws, or to protect the safety of the WixeChat community.

9. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WIXECHAT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WIXECHAT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR ACCESS TO OR USE OF THE SERVICE.
